1. About These Terms
These terms govern your use of the DataFirst REST API, WebSocket stream, bulk export, and MCP server (together, the "API"), provided by DataFirst Trading LLC ("DataFirst"). They supplement our Terms of Service and Market data terms. If they conflict on a point specific to the API, these terms control, except that the Market data terms always control over market data.
2. API Keys
Your API key is for your own use. Keep it secret, do not share it or build it into anything other people can read, and tell us right away if you think it has been exposed. You are responsible for all use of your key. Accounts and keys may not be shared, including through shared logins, bots, or automated relays.
3. Plans and Limits
Each plan has limits on requests per second, calls per day, symbols, and how far back you can read, as shown on the API page. A call is every request to the API, and one question to an AI assistant can make several calls. The daily count resets at midnight New York time. Going over a limit may return an error or slow your requests. We may suspend keys whose use threatens the stability of the Service.
4. Your Use of the Data
Data you receive through the API, including values derived from it, is covered by your market data agreement and may not be redistributed. Real-time data requires accepting the subscriber agreement and stating whether you are a Professional or Nonprofessional subscriber.
You may use the API in your own scripts, dashboards, models, and agents for your own personal use or, if you qualify and are registered with us as a Professional subscriber, for your own business's internal use. Using the data for a business or firm requires Professional status, and additional market data charges may apply. Professional status does not allow redistribution. Unless we agree in a separate written agreement, and any required exchange or OPRA approvals are in place, you may not:
- resell, retransmit, publish, or display the data, or anything derived from it, to anyone else;
- offer the data, or a product or feed built on it, to your customers or the public;
- share access with other people, including through a shared key, shared login, bot, or relay;
- use the API to build or benchmark a competing data product; or
- get around plan limits, keys, or security measures, for example by using several accounts.
5. MCP Server and AI Assistants
You can connect the MCP server to an AI assistant you use yourself. You choose that assistant and are responsible for your agreement with its provider, including what it does with data sent to it. AI assistants can misread data and make mistakes, so check anything important before relying on it. The limits in these terms apply to everything an assistant does with your key.
6. Availability and Changes
We may change endpoints, fields, limits, and plan features. We will try to give reasonable notice of changes that would break your integration, but we do not promise any level of uptime or latency unless a separate written agreement says so.
7. Billing and Cancellation
API plans are billed monthly or yearly as chosen at checkout and renew automatically until cancelled. You can cancel at any time, and access continues to the end of the paid period. Our Refund & Cancellation Policy applies.
8. Suspension and Termination
We may suspend or end your access for a breach of these terms, for non-payment, if our data providers require it, or to protect the Service. When your access ends, you must stop using the API and delete any data you are no longer licensed to keep.
9. No Financial Advice
The API is for information only and is not investment advice. Please read our Financial Disclaimer. You are responsible for anything you build with the API and any decision made using it, including automated ones.
10. Warranties and Liability
The Service is provided as described in the disclaimer of warranties and limitation of liability in our Terms of Service, which apply to these terms and control.
11. Governing Law and Disputes
These terms are governed by the same law, and disputes about them are resolved in the same way, as our Terms of Service.
12. Changes to These Terms
We may update these terms. When we make a material change, we will update the effective date and may notify you by email. If you keep using the API after a change takes effect, you accept the updated terms.
